Tampa Laundry Company LLC d/b/a Dohbi

Effective May 20, 2026 · SMS revision 11.2

PLEASE READ THESE TERMS CAREFULLY. By creating an Account, scheduling a pickup, or otherwise using the Services, you (the “Customer,” “you,” or “your”) agree to these Terms and Conditions of Service (the “Terms”) and enter into a binding legal agreement with Tampa Laundry Company LLC, a Florida limited liability company doing business as Dohbi (“Dohbi,” “we,” “our,” or “us”). If you do not agree, do not use the Services.

AUTO-RENEWAL DISCLOSURE (Fla. Stat. § 501.165). UNLESS YOU CANCEL, YOUR DOHBI SUBSCRIPTION WILL CONTINUE FROM ONE BILLING CYCLE TO THE NEXT BY AUTOMATIC RENEWAL, AND YOUR PAYMENT METHOD WILL BE CHARGED THE THEN-CURRENT PRICE AT THE START OF EACH NEW BILLING CYCLE. DOHBI RESERVES THE RIGHT TO DECLINE TO RENEW ANY SUBSCRIPTION IN ITS DISCRETION (FOR EXAMPLE, IF SERVICES IN YOUR AREA ARE DISCONTINUED, IF YOUR ACCOUNT IS IN DEFAULT, OR FOR OTHER OPERATIONAL REASONS). You may cancel at any time, before the next billing date, through the cancellation feature on the Platform, by emailing cancel@dohbi.com, or by any other method described in Section 10.5. Cancellation fees and procedures are described in Section 10.

THESE TERMS CONTAIN A BINDING INDIVIDUAL ARBITRATION AGREEMENT AND CLASS ACTION WAIVER IN SECTION 24. By accepting these Terms, you agree to resolve disputes with Dohbi exclusively by individual arbitration and waive your right to participate in any class, collective, or representative action, except as expressly set forth in Section 24. You have the right to opt out of arbitration within 30 days of first accepting these Terms by following the procedure in Section 24.10.

ADDITIONAL KEY PROVISIONS: limitations on liability and damages (Sections 8, 16, and 20); compensation for lost or damaged items is limited to $50 per item, $150 per occurrence, and $300 in aggregate per Subscription Term under Standard Protection, with an optional Dohbi Care+ Protection Plan available for $19.95 per Subscription Term that increases the limits to $100 per item, $400 per occurrence, and $500 in aggregate (Section 8.3); items that must not be tendered for service (Section 7.1) and Household Items that may be tendered for separate billing (Section 7.2); your obligation to indemnify Dohbi for certain claims (Section 21); a contractual one-year limitation period for bringing claims against Dohbi (Section 25); a 14-day cooling-off period for cancellation followed by a $50 cancellation fee (Section 10.4), which applies whether or not Services have yet commenced; deduction of credit card processing fees from refunds during the Cooling-Off Period (Section 10.4); and SMS communications consent (Section 23). Please review these sections carefully.

2. ACCEPTANCE; ELIGIBILITY

2.1 Binding Agreement

By clicking “I agree,” creating an Account, placing an Order, scheduling a pickup, or otherwise accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and the Privacy Policy. If you are accepting these Terms on behalf of another person (such as a student for whom you are paying), you represent and warrant that you have authority to bind that person and that you and that person are jointly and severally responsible under these Terms. Dohbi reserves the right to require additional written acknowledgment for high-value transactions.

2.2 Age and Capacity

You must be at least 18 years of age and have legal capacity to enter into a binding contract. If you are under 18, you may use the Services only if a parent or legal guardian has accepted these Terms on your behalf and assumes responsibility for all use of the Services and all payment obligations. Dohbi may, at any time, request reasonable verification of age, identity, or guardianship and may suspend access pending verification.

2.3 Student Eligibility

The Services are marketed primarily to college and university students. You represent that you are either (a) a currently enrolled student at an institution within the Service Area, (b) a parent, guardian, or other Payor purchasing the Services for such a student, or (c) otherwise a resident within the Service Area authorized to use the Services. Dohbi reserves the right to verify student status and to modify or terminate Services if eligibility cannot be confirmed.

2.4 Account Responsibility and Security

You are responsible for maintaining the confidentiality of your Account credentials and for all activity that occurs under your Account, whether or not authorized by you. You agree to (a) provide accurate and current registration information, (b) promptly update your information as needed, and (c) notify Dohbi immediately at hello@dohbi.com of any unauthorized access. Dohbi is not liable for any loss arising from your failure to safeguard your credentials.

2.5 Pre-Purchase Disclosures; Florida Automatic Renewal Act

Before any subscription purchase is finalized, Dohbi will clearly and conspicuously display, in accordance with the Federal Trade Commission’s Restore Online Shoppers’ Confidence Act (15 U.S.C. § 8401 et seq., “ROSCA”), the Florida Automatic Renewal Act (Fla. Stat. § 501.165), the California Automatic Renewal Law (Cal. Bus. & Prof. Code §§ 17600 et seq.), the New York Automatic Renewal Law (N.Y. Gen. Bus. Law § 527-a), and other Applicable Law:

  • the Subscription Plan price (including any introductory rate and the post-introductory rate);
  • the recurring nature of the charge, the billing cycle, and that the Subscription Plan will continue and renew automatically from one billing cycle to the next unless canceled, subject to Dohbi’s right to decline to renew under Section 10.2 (displayed in bold or otherwise conspicuous type immediately adjacent to the affirmative consent mechanism, as required by Fla. Stat. § 501.165);
  • the cancellation policy, including the $50 cancellation fee described in Section 10.4 (which includes Dohbi’s payment-processing costs for the original transaction), the deduction of credit card processing fees from refunds during the Cooling-Off Period, and the method for cancellation;
  • the included laundry weight allowance and per-pound overage rate;
  • the Standard Protection compensation limits for lost or damaged items included with every Subscription Plan, and the availability and price of the optional Dohbi Care+ Protection Plan ($19.95 per Subscription Term), as described in Section 8.3;
  • any free trial or promotional terms and the deadline for canceling before being charged.

You acknowledge that you affirmatively consented to the automatic renewal provision as part of the checkout flow and that such consent satisfies the requirements of Fla. Stat. § 501.165 and other applicable consumer protection statutes.

Dohbi will present the auto-renewal disclosure, recurring charge authorization, billing cycle, post-introductory price (if any), and cancellation method in clear and conspicuous form immediately adjacent to the affirmative consent mechanism (such as the “Agree and Pay” or “Subscribe” button) on the checkout flow. Renewal reminders, where required by Applicable Law or otherwise sent by Dohbi as a courtesy, will include the renewal price, renewal date, and a direct link to the cancellation feature.

2.6 Electronic Signatures and Communications

You consent to receive these Terms and all related notices, disclosures, and communications in electronic form (including by email, in-app notification, or posting to the Platform). Your electronic acceptance (including by clicking an “I agree” button or similar mechanism) constitutes your signature under the federal Electronic Signatures in Global and National Commerce Act (15 U.S.C. § 7001 et seq., the “E-SIGN Act”), the Florida Electronic Signature Act (Fla. Stat. §§ 668.001 et seq.), and similar state laws. You may withdraw your consent to electronic communications at any time, but doing so will terminate your access to the Services. To request a paper copy of any communication, contact hello@dohbi.com; a reasonable copying fee may apply to the extent permitted by Applicable Law.

3. THE SERVICES

3.1 Scope

Dohbi provides residential wash, dry, and fold services for everyday machine-washable garments and linens. The Services do not include dry cleaning, hand-washing, ironing, pressing, alterations, leather or suede care, fur care, shoe care, athletic-equipment cleaning, or any other specialty service. Dohbi does not represent itself as a professional cleaner of specialty items, and no provision of these Terms or any communication from Dohbi shall be construed as such a representation.

3.2 Service Area; Modifications

The Services are available only in the Service Area, which is subject to change. Dohbi may, at any time and without liability except as stated below, add, modify, suspend, or discontinue any portion of the Services, including pickup frequency, weight allowances, route schedules, and supported buildings, residence halls, or campuses. If Dohbi discontinues Services in your Service Area or materially modifies the Services in a manner that substantially impairs the benefits of your prepaid Subscription Plan, Dohbi will issue a pro-rata refund of prepaid, unused fees for the remainder of the then-current Subscription Term. Dohbi will provide reasonable advance notice of any material change.

3.3 Academic Calendar; Breaks and Holidays

Because the Services serve student populations, Dohbi may suspend or modify Services during academic breaks (including winter break, spring break, summer recess, and university holidays). Suspension during scheduled breaks does not extend the Subscription Term or entitle you to a refund unless expressly provided in your Subscription Plan or required by Applicable Law. Dohbi will use commercially reasonable efforts to communicate break schedules in advance.

3.4 Capacity; Surge Periods

During high-demand periods (e.g., move-in, move-out, finals, parents’ weekend, hurricane preparation in Florida), pickup and delivery windows may be longer than usual. Dohbi will work in good faith to fulfill scheduled Orders but does not guarantee specific times during surge periods.

3.5 University Partnerships

Where Dohbi provides Services pursuant to a university or campus housing partnership, additional rules of the institution may apply (including residence-hall access protocols, locker locations, and pickup hours). The terms of such partnership do not create any third-party-beneficiary rights in favor of the institution and do not modify these Terms as between you and Dohbi.

4. PICKUP AND DELIVERY

4.1 Scheduling

All Orders must be scheduled through the Platform. Dohbi may decline, reschedule, or reroute Orders for operational, safety, weather-related, or capacity reasons.

4.2 Time Windows

Pickup and delivery windows displayed on the Platform are good-faith estimates and not guarantees. Dohbi is not liable for delays caused by traffic, weather, hurricanes or tropical storms, weather-related emergencies, campus or building access restrictions, university or law-enforcement directives, third-party carriers, or any other cause outside Dohbi’s reasonable control.

4.3 Missed Pickups; Wrong-Address Charges

If a scheduled pickup or delivery cannot be completed because Customer Items are not made available at the Designated Location, the address is incorrect, building access is denied, or the Customer or Authorized User is unavailable, Dohbi may assess a missed-trip fee of $15 per occurrence (or such other amount as Dohbi displays on the Platform). No missed-trip fee will be assessed where the failure was caused by Dohbi (including a driver’s failure to attempt the pickup or a Dohbi system error) or by a Force Majeure Event. The missed-trip fee represents a reasonable forecast of Dohbi’s actual costs of dispatch, fuel, driver time, and lost capacity, which are difficult or impossible to ascertain with precision. Repeated missed pickups attributable to you may result in suspension of Services without refund.

4.4 Designated Location; Authorized Access

You agree to specify a Designated Location that is reasonably accessible, safe, and visible. You authorize Dohbi to access the Designated Location for pickup and delivery, including residence hall entrances, lobbies, mailrooms, designated laundry lockers, and front desks. You represent that you have authority to grant such access. Dohbi is not responsible for items left at the Designated Location after delivery, including loss, theft, or weather-related damage.

4.5 Completed Delivery; Risk of Loss

Delivery is deemed complete, and risk of loss passes to you, when Customer Items are (a) left at the Designated Location, (b) delivered to authorized building personnel (including front-desk staff, resident advisors, mailroom attendants, or porters), (c) placed in a designated locker accessible to you, or (d) handed to any Authorized User. Dohbi is not liable for items lost, stolen, or damaged after delivery is complete.

Where commercially feasible, Dohbi will document completed delivery by a timestamped photo, signed receipt, locker log entry, or other contemporaneous record. The absence of such documentation does not, by itself, disprove delivery. Records of delivery, when maintained, may be relied upon to resolve disputes.

4.6 Inclement Weather; Hurricanes and Public Safety

Dohbi may delay, suspend, or cancel pickups and deliveries due to hurricanes, tropical storms, severe weather, public safety advisories, campus lockdowns, mandatory evacuations, or other safety considerations. Affected pickups will be rescheduled when reasonably practicable. Suspensions of 7 days or less do not entitle you to a refund or credit.

4.7 Dohbi-Provided Bags and Equipment

Dohbi-provided laundry bags issued to you for use of the Services become your property upon issuance and need not be returned to Dohbi. Other Dohbi-provided equipment, including lockers, locker access codes, and any Dohbi-owned hardware, remains Dohbi’s property and must be returned in good condition upon termination of your Subscription Plan. You may be charged a reasonable replacement fee for lost or destroyed Dohbi-owned equipment (other than bags), as disclosed on the Platform.

5. PRICING AND PAYMENT

5.1 Prices

Prices for Subscription Plans and ancillary Services are as displayed on the Platform at the time of purchase. Dohbi’s wash, dry, and fold Services are not currently subject to Florida sales tax. To the extent any sales, use, or other tax becomes applicable to the Services in any jurisdiction in which Dohbi operates (whether due to changes in tax law, expansion of the Service Area, or otherwise), Dohbi will collect such tax in addition to the displayed price where required by Applicable Law; the economic burden of any such tax is borne by you as the Customer.

5.2 Price Changes

Dohbi may change Subscription Plan prices upon at least 30 days’ prior notice to you (or such longer period as required by Applicable Law). Any new price will apply to the next renewal of your Subscription Plan unless you cancel before the renewal in accordance with Section 10.

5.3 Payment Authorization

You authorize Dohbi (and its third-party payment processors) to charge your designated payment method for (a) all Subscription Plan fees on a recurring basis, (b) any overage charges under Section 5.6, (c) any cancellation, missed-trip, equipment-replacement, special-handling, or other ancillary fees, and (d) all applicable taxes. You represent that you are the authorized user of the payment method or that the cardholder has consented to such charges, and that you will resolve any dispute regarding authorization between you and the cardholder directly.

5.4 Failed Payments

If a payment is declined, Dohbi may (a) retry the charge using commercially reasonable methods, (b) suspend Services until payment is received, (c) assess a reasonable late fee or returned-payment fee to the extent permitted by Applicable Law, and (d) refer past-due balances to collection. You agree to keep your payment information current.

5.5 Refunds

Except as expressly stated in these Terms or required by Applicable Law, all payments are non-refundable. Service credits issued by Dohbi (a) are non-transferable, (b) have no cash value, and (c) expire upon termination of your Account.

5.6 Included Weight and Overage Charges

Each Subscription Plan includes a stated laundry weight allowance per pickup or per Subscription Term. If Customer Items exceed the included weight allowance:

  • Additional weight is billed at $2.99 per pound (or such rate as displayed on the Platform);
  • Overage charges are applied automatically to the payment method on file;
  • Overage charges are itemized on the receipt for the relevant Order.

Dohbi uses commercially reasonable weighing methods. Weight disputes must be submitted within fourteen (14) days of the receipt date and will be reviewed in good faith. Upon reasonable request, Dohbi will provide available weighing records and bag-labeling photographs supporting the charge. Dohbi will adjudicate weight disputes within 10 Business Days of receiving all supporting information.

5.7 Promotional Codes; Referrals; Anti-Abuse

Dohbi may from time to time offer promotional codes, referral credits, gift subscriptions, or other incentives. Promotions are subject to additional terms disclosed at the time of the offer, may not be combined with other offers, are non-transferable, have no cash value, and may be revoked or modified at Dohbi’s discretion. Dohbi may suspend or terminate any Account it determines, in its reasonable discretion, has obtained promotional benefits through fraud or abuse (including creation of duplicate or multiple Accounts, self-referrals, bot activity, or providing false information). Dohbi may also reverse any promotional credit obtained in violation of these Terms.

5.8 Pre-Renewal Notice

As a customer-service practice, Dohbi will use commercially reasonable efforts to send a pre-renewal email reminder approximately three (3) days before each automatic renewal charge, stating the renewal amount, the renewal date, and a direct link to the cancellation feature. State-specific timing requirements (see Section 32) control where applicable. Failure or delay in sending a courtesy pre-renewal reminder does not invalidate the renewal where the automatic renewal terms have been disclosed in accordance with Section 2.5 and Applicable Law.

5.9 Gift Subscriptions

Dohbi may offer gift subscriptions for purchase. Gift subscriptions are non-refundable, non-transferable except to the named recipient, must be activated within 12 months of purchase, commence upon first pickup or as otherwise stated at purchase, and are subject to these Terms upon activation. Unused gift subscriptions not activated within 12 months are forfeited to the extent permitted by Applicable Law (including any state-specific gift-card or stored-value laws).

6. CUSTOMER RESPONSIBILITIES AND REPRESENTATIONS

You represent, warrant, and agree that:

  • All Customer Items are free of biohazards (including blood, vomit, bodily fluids, fecal matter, mold, and bedbugs or other infestations) and are reasonably safe to handle;
  • All Customer Items are suitable for standard machine wash, tumble dry, and folding without the need for specialty care, and you have inspected care labels before tendering items;
  • All pockets have been emptied; Dohbi is not responsible for items left in pockets (including cash, jewelry, electronics, AirPods or wireless earbuds, keys, IDs, credit cards, medications, vape devices, or other valuables);
  • No Prohibited Items (as defined in Section 7.1) have been included in any Order;
  • Stains have been disclosed where reasonably visible; Dohbi makes no guarantee of stain removal;
  • Where you include Household Items (as defined in Section 7.2) in an Order, you authorize Dohbi to process them and to charge the applicable per-piece Household Item fee to your payment method on file;
  • You are the owner of, or have authority to tender, all Customer Items, and the Customer Items are not subject to any third-party rights inconsistent with Dohbi’s handling of them.

6.1 Shared Living Environments

You acknowledge that you may reside in a shared dormitory, apartment, suite, or other shared environment. You are solely responsible for identifying and segregating your own Customer Items. Dohbi is not responsible for mix-ups, mis-deliveries, or losses caused by roommates, suitemates, building staff, or other third parties accessing your laundry, the Designated Location, or your Account.

6.2 Labeling

Dohbi recommends that you use Dohbi-provided bags and labels. Failure to use Dohbi-provided identification may delay returns and may be considered in any determination of liability under Section 8.

6.3 Intake Inspection; Right to Refuse or Surcharge

Dohbi reserves the right, upon intake or at any time during processing, to refuse to wash, return unwashed (at your cost where applicable), quarantine, dispose of (in accordance with Section 7 and Applicable Law), or charge a decontamination or special-handling fee for any Customer Items determined, in Dohbi’s reasonable judgment, to contain biohazards, infestation, hazardous materials, or other contamination. Decontamination and special-handling fees, where assessed, will be in amounts disclosed on the Platform or in a written notice to you and will be charged automatically to the payment method on file.

7. PROHIBITED ITEMS; HOUSEHOLD ITEMS

7.1 Prohibited Items

The following items are prohibited and must not be included in any Order. Dohbi will not accept these items for service. Dohbi accepts no liability for loss of, damage to, or harm caused by such items, and you agree to indemnify Dohbi for any loss arising from their inclusion:

  • Items requiring dry cleaning, hand-wash-only, or specialty care, including (without limitation) wool, silk, leather, suede, fur, cashmere, sequined or beaded garments, and embroidered or appliquéd items;
  • Designer, vintage, heirloom, or one-of-a-kind items, or any single item with a retail or replacement value in excess of $100;
  • Hazardous materials, including flammable substances, ammunition, weapons, sharps, batteries, chemicals, controlled substances or other drugs (lawful or unlawful), or anything that may damage equipment, injure personnel, or violate Applicable Law during transport or handling;
  • Items contaminated with bodily fluids, mold, mildew, asbestos, bedbugs, lice, or other biohazards;
  • Money, wallets, identification, passports, credit or debit cards, keys, electronics, headphones, jewelry, watches, vape or e-cigarette devices, or any other valuables;
  • Items subject to a legal hold, evidentiary preservation order, or otherwise unlawful to transport or possess.

Dohbi may, in its sole discretion, refuse to wash, return unwashed, dispose of (with notice where reasonably practicable in the case of valuables), or charge a special-handling fee for any Prohibited Item included in an Order.

7.2 Household Items (Accepted with Separate Per-Piece Billing)

The following items (“Household Items”) are not included in your Subscription Plan’s standard wash, dry, and fold Services but will be accepted by Dohbi for cleaning at separate per-piece charges as disclosed on the Platform:

  • Comforters, duvets, and duvet covers;
  • Pillows and pillow inserts (machine-washable only);
  • Sleeping bags;
  • Blankets and throws;
  • Weighted blankets;
  • Mattress pads and toppers (machine-washable only);
  • Curtains and other oversized household textiles (machine-washable only).

Household Items must be machine-washable, free of biohazards, and otherwise eligible for standard laundering. Items that require dry cleaning or specialty care are Prohibited Items under Section 7.1, regardless of their household character, and will not be accepted.

By including Household Items in an Order, you authorize Dohbi to process them and to charge the applicable per-piece Household Item fee, as disclosed on the Platform, to your payment method on file under Section 5.3. If you do not wish for a Household Item to be processed at the disclosed per-piece fee, do not include it in your Order. Dohbi will use reasonable care in processing Household Items consistent with industry practice but does not guarantee against ordinary cleaning effects (such as shrinkage, fading, color transfer, or loss of fill loft). Compensation for loss or damage to Household Items is governed by Section 8, including the per-item and aggregate caps.

8. LOSS, DAMAGE, AND CLAIMS

8.1 Standard of Care

Dohbi will exercise reasonable, commercially appropriate care in handling Customer Items consistent with industry standards for commercial wash, dry, and fold services. Dohbi does not guarantee against ordinary wash-and-wear effects, including shrinkage, fading, color transfer, pilling, loss of elasticity, or damage attributable to manufacturer defects, prior wear, or pre-existing condition.

8.2 Claims Procedure

To submit a Claim, you must:

  • Submit the Claim through the Platform or to claims@dohbi.com within fourteen (14) days of delivery. For damage not reasonably discoverable upon delivery (“latent damage”), the Claim must be submitted within 14 days of the date the damage was, or with reasonable diligence should have been, discovered, and in no event later than 30 days after delivery. Dohbi will not be able to investigate or locate items, or to identify processing records, for Claims submitted after these periods, and you acknowledge that these periods are reasonable and necessary in light of the high volume of comingled laundry processed by Dohbi;
  • Identify the specific item(s) at issue and describe the nature of the loss or damage;
  • Provide reasonable supporting documentation, which may include: photographs of the damage, proof of original purchase (receipt, order confirmation, bank or credit-card statement, or comparable evidence), care label, and the original Dohbi Order ID;
  • Make the damaged item reasonably available for inspection by Dohbi or its designee if requested.

Claims not submitted within the applicable period or unsupported by required documentation may be denied. Dohbi will acknowledge Claims within 5 Business Days and issue a written determination within 30 days, subject to receipt of complete documentation.

8.3 Compensation Limits; Standard Protection and Dohbi Care+ Protection Plan

Where Dohbi determines, in good faith, that Customer Items were lost or damaged due to Dohbi’s failure to exercise the standard of care set forth in Section 8.1, Dohbi will compensate you, at Dohbi’s option, by repair, replacement, or payment of Fair Market Value, subject to the limits set forth in this Section 8.3.

Two coverage tiers are available:

(a) Standard Protection (included with every Subscription Plan, at no additional charge):

  • Up to $50 per item;
  • Up to $150 per Occurrence (regardless of the number of items lost or damaged in that Occurrence); and
  • Up to $300 in aggregate per Subscription Term.

(b) Dohbi Care+ Protection Plan (optional; $19.95 per Subscription Term, or such other price as Dohbi may disclose on the Platform). If you purchase Dohbi Care+ at the time of Subscription Plan purchase or thereafter through the Platform, the following limits apply for the remainder of the Subscription Term in which Dohbi Care+ is in effect:

  • Up to $100 per item;
  • Up to $400 per Occurrence (regardless of the number of items lost or damaged in that Occurrence); and
  • Up to $500 in aggregate per Subscription Term.

Dohbi Care+ also includes priority claim handling (acknowledgment within one (1) Business Day and good-faith determination within fourteen (14) days of complete documentation), delivery confirmation photographs where reasonably feasible, and access to in-app pre-pickup item documentation tools.

Nature of Dohbi Care+. Dohbi Care+ is a contractual upgrade of Dohbi’s service-level commitment to you. It is not an insurance policy, does not constitute insurance, and does not transfer risk to any third-party insurer. Dohbi remains the sole obligor for all compensation under this Section 8.3. Dohbi Care+ applies only to Occurrences arising during a Subscription Term in which it has been activated and paid for; it does not apply retroactively to Occurrences before activation. If you cancel your Subscription Plan, Dohbi Care+ terminates with it.

Definition of “Occurrence.” For purposes of this Section 8.3, an “Occurrence” means a single pickup, processing, or delivery event in which one or more Customer Items are lost or damaged. Multiple items lost or damaged in the same Occurrence count as one Occurrence, regardless of the number of items. Multiple Occurrences across the Subscription Term are subject to the aggregate cap. Where the same item is the subject of multiple alleged events, Dohbi may, in its reasonable discretion, consolidate them as a single Occurrence.

Proof of Value. Items for which you cannot produce reasonable proof of original purchase (such as a receipt, order confirmation, bank or credit-card statement, or comparable evidence) will be compensated at no more than $25 per item under Standard Protection or $50 per item under Dohbi Care+, or refused at Dohbi’s reasonable discretion.

Pattern-of-Claims Rule. Dohbi may, in its reasonable discretion, suspend or terminate any Account, deny any Claim, or decline to renew any Subscription Plan where the pattern of Claims submitted by the Account is materially inconsistent with the Subscription Plan size, the customer’s pickup history, or the customary loss/damage rates Dohbi experiences in its business. Examples include multiple high-value Claims within a short period, Claims for items materially exceeding what was reasonably contained in the pickup, or Claims accompanied by inconsistent or fabricated supporting documentation.

Pre-Existing Condition. Where Dohbi has photographic or other documentary evidence that an item was in a particular condition at pickup or delivery, that evidence will be considered dispositive of pre-existing condition unless rebutted by clear evidence to the contrary.

Gross Negligence and Willful Misconduct. The foregoing limits do not apply where prohibited by Applicable Law or in cases of Dohbi’s gross negligence or willful misconduct.

Acknowledgment of Reasonableness. You agree that these limits are reasonable in light of (i) the price of the Services, (ii) the availability of the Dohbi Care+ upgrade, (iii) the difficulty of insuring or appraising commingled laundry items, and (iv) the Prohibited Items provisions of Section 7.1 (which exclude high-value, designer, and specialty-care items from intake). By electing not to purchase Dohbi Care+, you acknowledge that you have been offered the opportunity to obtain increased coverage and have chosen not to.

8.4 Exclusions from Compensation

Dohbi will not provide compensation for:

  • Pre-existing damage, normal wear and tear, manufacturer defects, or damage resulting from prior treatment of the item;
  • Loss or damage caused by your failure to follow care label instructions, mislabeling, or misrepresentation of the item;
  • Items not properly labeled or identified, where such labeling was reasonably required by Dohbi’s intake process;
  • Items lost, stolen, or damaged after delivery is complete under Section 4.5;
  • Loss of, or damage to, items left in pockets;
  • Items prohibited under Section 7;
  • Sentimental, custom, irreplaceable, or non-economic value beyond Fair Market Value.

8.5 Sole and Exclusive Remedy

To the fullest extent permitted by Applicable Law, the compensation described in this Section 8 is your sole and exclusive remedy for any loss of or damage to Customer Items, and you agree not to assert, in connection with the handling of Customer Items, any claim for civil theft under Fla. Stat. § 772.11 or analogous statutes, conversion, bailment, breach of bailment, or other common-law or statutory cause of action seeking remedies broader than those provided in this Section 8. Nothing in this Section 8.5 waives, or is intended to waive, any non-waivable statutory right, including any right under the Florida Deceptive and Unfair Trade Practices Act or any other consumer protection statute that cannot be waived by contract.

9. SERVICE QUALITY ISSUES

For service quality concerns that do not involve loss or damage (such as residual stains, incomplete folding, or odor), notify Dohbi through the Platform within 72 hours of delivery. Dohbi may, in its discretion, offer:

  • Re-cleaning of the affected Order at no additional cost;
  • A service credit toward future Orders; or
  • A refund up to the price of the affected Order.

Compensation for actual loss of or damage to items is governed exclusively by Section 8.

10. SUBSCRIPTIONS, AUTO-RENEWAL, AND CANCELLATION

10.1 Subscription Plans

Subscription Plans are sold on a recurring basis as specified at the point of purchase. Each Subscription Plan continues for its Subscription Term and renews automatically as described below unless canceled in accordance with this Section.

10.2 Auto-Renewal Within an Academic Year; No Cross-Year Auto-Renewal; Dohbi’s Right to Decline Renewal

Dohbi’s Subscription Plans correspond to academic semesters (a Fall semester Subscription Plan and a Spring semester Subscription Plan).

AUTO-RENEWAL FROM FALL TO SPRING. UNLESS YOU CANCEL IN ACCORDANCE WITH SECTION 10.5, A FALL SEMESTER SUBSCRIPTION PLAN WILL AUTOMATICALLY RENEW INTO THE FOLLOWING SPRING SEMESTER SUBSCRIPTION PLAN AT THE THEN-CURRENT PRICE, AND YOUR PAYMENT METHOD WILL BE AUTOMATICALLY CHARGED FOR THE SPRING SEMESTER ON OR ABOUT THE RENEWAL DATE.

NO AUTO-RENEWAL AFTER SPRING. SPRING SEMESTER SUBSCRIPTION PLANS DO NOT AUTOMATICALLY RENEW. To continue receiving Services in the following academic year, you must affirmatively re-enroll and purchase a new Fall semester Subscription Plan through the Platform. Dohbi will send a re-enrollment invitation by email before the next academic year, but in no event will Dohbi charge your payment method for the new academic year without your express, separate consent obtained at the time of re-enrollment.

Notwithstanding the foregoing, Dohbi reserves the right, in its sole and reasonable discretion, to decline to renew any Fall-to-Spring Subscription Plan and to terminate the subscription at the end of the Fall semester without further obligation, including (without limitation) where:

  • Dohbi has discontinued or modified Services in your Service Area;
  • your Account is past due, has a failed payment, or has been subject to a chargeback or other payment dispute;
  • Dohbi reasonably suspects fraud, misuse, abuse of promotional benefits, or violation of these Terms;
  • you have failed to maintain accurate Account information or an authorized payment method;
  • your Subscription Plan or pricing tier is being retired or restructured; or
  • Dohbi otherwise determines, in good faith, that renewal is not commercially or operationally appropriate.

If Dohbi declines to renew a Fall-to-Spring Subscription Plan, Dohbi will provide reasonable notice by email to the address associated with your Account, and your access to the Services will end at the conclusion of the Fall semester. Where Dohbi declines to renew other than for cause attributable to you (such as discontinuation of Services in your Service Area or business-driven plan retirement), Dohbi will issue a pro-rata refund of any prepaid, unused fees attributable to the post-Subscription-Term period. Dohbi’s decision not to renew is not a breach of these Terms. Dohbi’s exercise (or non-exercise) of this discretion in any one instance does not constitute a waiver of the right to exercise it in any other instance.

10.3 Renewal Reminders

Because Dohbi’s Subscription Plans are semester-length (and therefore shorter than 12 months), the long-term renewal notice requirements of the Florida Automatic Renewal Act (Fla. Stat. § 501.165(3)), the California Automatic Renewal Law, and the New York Automatic Renewal Law do not apply to the Fall-to-Spring auto-renewal under Section 10.2. As a customer-service practice, Dohbi will nonetheless use commercially reasonable efforts to send an email reminder to you in advance of the Fall-to-Spring auto-renewal, identifying the renewal price, the renewal date, and a direct link to the cancellation feature. You consent to receive such notices by email at the address associated with your Account. Failure or delay in sending such a courtesy reminder does not invalidate a renewal where the auto-renewal terms have been disclosed in accordance with Section 2.5 and Applicable Law.

10.4 Cooling-Off Period; Cancellation Fee; Refunds upon Cancellation

(a) Cooling-Off Period. You may cancel a Subscription Plan within fourteen (14) days of the date of initial purchase (the “Cooling-Off Period”) for any reason, and Dohbi will refund all amounts paid for the canceled Subscription Plan, less (i) any amounts attributable to Services actually performed before the cancellation, and (ii) the Processing Fee Deduction (defined in Section 10.4(d)). No Cancellation Fee will be assessed for cancellations during the Cooling-Off Period.

(b) Cancellation Fee. After the Cooling-Off Period, a cancellation fee of $50 (the “Cancellation Fee”) will be assessed on any cancellation of a Subscription Plan, regardless of whether Services have yet commenced. The Cancellation Fee represents a reasonable, good-faith estimate of Dohbi’s actual costs incurred at or near the time of purchase that are difficult or impractical to determine with precision in any individual case and that Dohbi cannot recoup if the Subscription Plan is canceled, including payment-processing fees charged by Dohbi’s third-party payment processor, customer-acquisition and marketing costs, account onboarding, and consumable materials (such as the Dohbi-provided laundry bag) issued to you and not recovered. Because the Cancellation Fee already includes Dohbi’s payment-processing costs, no separate Processing Fee Deduction is applied to cancellations after the Cooling-Off Period. You and Dohbi agree that the Cancellation Fee is a reasonable liquidated-damages amount and not a penalty.

(c) Pre-Service Purchases. You acknowledge that Subscription Plans are commonly purchased in advance of the academic semester or other intended service period (for example, a Subscription Plan purchased in June for Services commencing in August). The Cooling-Off Period begins on the date of purchase, not the date Services commence. Dohbi incurs material operational, onboarding, route-planning, marketing, and other costs at or near the time of purchase and not only when Services commence. Accordingly, the Cancellation Fee applies to cancellations made after the Cooling-Off Period whether or not Services have yet commenced. This Section 10.4(c) is disclosed at the time of purchase pursuant to Section 2.5.

(d) Refunds upon Cancellation; Processing Fee Deduction. Refunds upon cancellation are calculated as follows:

  • If you cancel during the Cooling-Off Period: full refund of all amounts paid for the canceled Subscription Plan, less amounts attributable to Services actually performed and less the Processing Fee Deduction.
  • If you cancel after the Cooling-Off Period but before any pickup has occurred: refund of all amounts paid for the canceled Subscription Plan, less the Cancellation Fee. No separate Processing Fee Deduction applies, because the Cancellation Fee already includes Dohbi’s payment-processing costs.
  • If you cancel after the Cooling-Off Period and after Services have commenced: pro-rata refund calculated based on the portion of the Subscription Term not yet elapsed as of the cancellation effective date (or, for plans priced per pickup rather than per period of time, based on the number of pickups not yet completed), less the Cancellation Fee. No separate Processing Fee Deduction applies, because the Cancellation Fee already includes Dohbi’s payment-processing costs.

The “Processing Fee Deduction” means the actual credit card, debit card, or other payment-method processing fees that Dohbi incurred from its third-party payment processor in connection with the original transaction and any associated refund. Where applied, the Processing Fee Deduction reflects only the actual fees charged to Dohbi by its third-party processor (typically a small percentage of the transaction amount plus a small per-transaction charge) and is not a penalty. The Processing Fee Deduction will be itemized on the refund receipt. Dohbi’s election not to apply the Processing Fee Deduction in any particular instance is not a waiver of its right to apply it in any other instance.

(e) Other Exceptions to the Cancellation Fee. In addition to the Cooling-Off Period in Section 10.4(a), no Cancellation Fee will be assessed if you cancel:

  • in response to a material adverse change to these Terms under Section 27, where notice of cancellation is given within 30 days after the effective date of the change;
  • because Dohbi has discontinued Services in your Service Area, materially failed to perform, or materially modified the Services to substantially impair the benefit of the Subscription Plan; or
  • during any statutory cooling-off period required by Applicable Law in your state (if longer than the Cooling-Off Period set forth above), or where assessment of the fee is otherwise prohibited by Applicable Law.

(f) Discretion; Anti-Abuse. Dohbi may waive the Cancellation Fee in its sole discretion. Dohbi may revoke promotional benefits and reverse promotional credits associated with Accounts determined, in Dohbi’s reasonable discretion, to be abusive or non-genuine.

10.5 How to Cancel

You may cancel your Subscription Plan at any time, by any of the following methods, in compliance with FTC and state online-cancellation requirements:

  • through the cancellation feature in your Account on the Platform (available 24/7 and requiring no greater effort than was required to subscribe);
  • by emailing cancel@dohbi.com (Dohbi may request reasonable verification of identity if the request does not come from the email address associated with your Account); or
  • for residents of states where required by Applicable Law, by the additional cancellation mechanisms identified in Section 32 (State-Specific Disclosures).

Cancellation is effective at the end of the then-current Subscription Term unless an earlier effective date is required by Applicable Law. Dohbi will provide written confirmation of cancellation by email.

Accessibility. If a disability prevents you from using the online cancellation feature, contact hello@dohbi.com and Dohbi will provide an equivalent, immediate cancellation method at no greater effort to you than the standard online flow.

10.6 Free Trials and Promotional Periods

Where Dohbi offers a free trial or promotional rate, the specific terms (including duration, conversion date, post-trial price, and method of cancellation before conversion) will be disclosed at the time of the offer in accordance with Section 2.5, ROSCA, and Applicable Law. Unless you cancel before the trial or promotional period ends, your Subscription Plan will convert automatically to the post-trial price and be charged to your payment method. Dohbi will use commercially reasonable efforts to send an email reminder before the trial converts; failure to send such a courtesy reminder does not invalidate the conversion or charge where the conversion terms were disclosed.

11. CHARGEBACKS

If you believe a charge was made in error, you agree to contact Dohbi at hello@dohbi.com before disputing the charge with your card issuer or bank. Improper or fraudulent chargebacks may result in (a) suspension or termination of your Account, (b) referral to collection, and (c) recovery by Dohbi of its actual chargeback-related costs (including processor fees imposed on Dohbi) and reasonable attorneys’ fees to the extent permitted by Applicable Law. Initiating a chargeback does not relieve you of any obligation to pay amounts validly owed under these Terms.

12. ABANDONED ITEMS

If Dohbi is unable, despite reasonable efforts, to return Customer Items to you (whether due to inability to access the Designated Location, failure to update Account information, account closure, lack of response by the Customer, or other reason), the items will be deemed abandoned if not retrieved or claimed within 30 days after the first attempted return. Dohbi may assess a reasonable storage fee, as disclosed on the Platform, for items held beyond 14 days from the first attempted return. Before disposing of, donating, or otherwise transferring abandoned items, Dohbi will use commercially reasonable efforts to contact you at least twice — by email and (where available) by SMS or in-app notification — using the contact information on file. Dohbi will maintain a record of contact attempts. Disposal, donation, or sale of abandoned items will be in accordance with Applicable Law, including Florida’s abandoned-property statutes and any state-specific notice and holding periods that apply to your jurisdiction. If Dohbi sells abandoned items, Dohbi may apply the net proceeds (after sale and storage costs) to amounts you owe Dohbi; any remaining balance will be remitted to you or escheated as required by Applicable Law.

13. USER CONDUCT AND PLATFORM USE

You agree not to (a) use the Services or Platform in violation of any Applicable Law, (b) interfere with or disrupt the Platform or Dohbi’s systems, (c) reverse engineer, scrape, or attempt to derive source code from the Platform, (d) impersonate any person or misrepresent your identity, (e) submit false or misleading information, (f) harass, threaten, intimidate, or abuse any Dohbi employee, contractor, driver, or other Customer, (g) use the Services for any commercial laundry business or to launder items belonging to third parties for profit, or (h) circumvent any access or rate limits. Dohbi may suspend or terminate access for violations of this Section, with or without notice.

14. INTELLECTUAL PROPERTY; USER CONTENT; FEEDBACK

14.1 Dohbi IP

The Platform, the Dohbi name and logos, and all related content, software, designs, and trademarks are the property of Dohbi or its licensors and are protected by intellectual property laws. Dohbi grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely to receive the Services.

14.2 User Content

You retain ownership of any content (including photographs, messages, and reviews) you submit through the Platform (“User Content”) and grant Dohbi a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, distribute, and display the User Content as necessary to provide the Services. This license is non-sublicensable except to Dohbi’s service providers acting on Dohbi’s behalf, and non-transferable except in connection with a sale, merger, or assignment of all or substantially all of Dohbi’s business or assets. With your separate, affirmative opt-in (which Dohbi will solicit through the Platform), Dohbi may also use the User Content for marketing and promotional purposes.

You represent and warrant that (a) you own or have all necessary rights to submit the User Content and grant the licenses described above, (b) the User Content does not infringe any third-party right or violate any Applicable Law, and (c) the User Content is not defamatory, harassing, obscene, or otherwise objectionable. Dohbi reserves the right, but has no obligation, to review, refuse, or remove any User Content that Dohbi determines, in its reasonable discretion, violates these Terms, Applicable Law, or any third-party right.

14.3 Feedback

If you provide suggestions, feedback, or ideas to Dohbi about the Services, you assign all rights in such feedback to Dohbi and acknowledge that Dohbi may use it without compensation or attribution.

14.4 DMCA / Copyright Complaints

If you believe content on the Platform infringes your copyright, send a notice that complies with 17 U.S.C. § 512(c)(3) to Dohbi’s designated agent: General Counsel, Tampa Laundry Company LLC d/b/a Dohbi, 4520 West Gandy Boulevard, Tampa, Florida 33611, with an electronic copy to legal@dohbi.com. Dohbi’s designated agent is also registered with the U.S. Copyright Office’s DMCA Designated Agent Directory. Dohbi may, in its discretion and consistent with 17 U.S.C. § 512, terminate the Accounts of repeat infringers.

15. PRIVACY AND DATA SECURITY

Dohbi’s collection, use, and disclosure of personal information is governed by the Dohbi Privacy Policy, available on the Platform, which is incorporated into these Terms by reference. By using the Services, you acknowledge and agree to the practices described in the Privacy Policy. In summary, Dohbi collects categories of personal information including identifiers (such as name, email, phone), payment information (handled by PCI-compliant third-party processors), Service-related information (such as Designated Location, pickup history, weight records, and photos), and device and usage data; details are in the Privacy Policy.

In the event of a security incident involving your personal information, Dohbi will provide notification as required by the Florida Information Protection Act (Fla. Stat. § 501.171) and other Applicable Law. Dohbi maintains reasonable administrative, technical, and physical safeguards consistent with industry standards. Dohbi retains records of SMS and email communications consents and opt-outs for a period sufficient to demonstrate compliance with TCPA, FTSA, and similar statutes, and in any event for not less than five (5) years from the date of consent or opt-out.

16. DISCLAIMERS; WARRANTIES

EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE SERVICES AND PLATFORM ARE PROVIDED “AS IS” AND “AS AVAILABLE,” AND DOHBI DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. DOHBI DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY STAIN, ODOR, OR DEFECT IN CUSTOMER ITEMS WILL BE FULLY REMOVED OR REMEDIED. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES; THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU IN FULL.

17. INSURANCE

Dohbi maintains commercial general liability and other insurance consistent with industry practice. Dohbi’s insurance is for Dohbi’s benefit and does not constitute a guarantee, indemnity, or warranty in favor of any Customer. No Customer is an additional insured under any Dohbi policy. You are encouraged to maintain your own renter’s, homeowner’s, or personal property insurance for items of value.

18. FORCE MAJEURE

Dohbi is not liable for any failure or delay in performance caused by events beyond its reasonable control, including acts of God; hurricanes, tropical storms, flooding, and other severe weather events; fire; earthquake; epidemic, pandemic, or public health emergency; war, terrorism, civil unrest, riot, or sabotage; governmental or quasi-governmental action, including emergency orders, mandatory evacuations, and curfews; labor disputes, strikes, or work stoppages; utility, internet, telecommunications, or payment-processor failures; cyberattacks, ransomware, or other malicious code; supply-chain disruptions; vehicle or equipment failure; or campus, university, or building closures or access restrictions (each, a “Force Majeure Event”). During a Force Majeure Event, affected obligations are suspended for the duration of the event; cancellation rights during such events are governed by Section 10 and Applicable Law.

Notwithstanding the foregoing, if Dohbi’s suspension of Services in your Service Area (whether attributable to a Force Majeure Event or otherwise) continues for more than seven (7) consecutive days, Dohbi will, upon your request, issue a pro-rata service credit or refund for the unused portion of any prepaid Subscription Plan attributable to the period of suspension. For suspensions exceeding fourteen (14) consecutive days, Dohbi will issue such pro-rata credit automatically without requiring a request. This pro-rata remedy is your sole and exclusive remedy for service interruption during a Force Majeure Event.

19. INDEPENDENT CONTRACTORS; DRIVERS; THIRD-PARTY PROVIDERS

Drivers, route partners, laundry processors, and certain other personnel providing the Services are independent contractors and not employees of Dohbi. Independent contractors are free from Dohbi’s control and direction in connection with the performance of services, except as expressly required by the parties’ written agreement, and are customarily engaged in an independently established trade. Nothing in these Terms creates an agency, partnership, joint venture, employer-employee, or franchise relationship between Dohbi and any Customer, or between Dohbi and any independent contractor for purposes of any Customer claim.

Dohbi may also use vetted third-party service providers, including payment processors, logistics partners, cleaning facilities, and technology vendors, in providing the Services. Such providers are bound by confidentiality and security obligations consistent with Dohbi’s standards. As between you and Dohbi, Dohbi remains responsible to you for the Services under these Terms. You agree to look to Dohbi (and not to Dohbi’s service providers) for performance of the Services and for remedies under these Terms, except where Applicable Law preserves a direct right of action against a service provider that cannot be contractually limited.

20. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

  • DOHBI, ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR LOSS OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATING TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES;
  • DOHBI’S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (i) THE AMOUNTS PAID BY YOU TO DOHBI IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY OR (ii) ONE HUNDRED U.S. DOLLARS ($100);
  • CLAIMS FOR LOST OR DAMAGED CUSTOMER ITEMS ARE GOVERNED EXCLUSIVELY BY SECTION 8 AND THE PER-ITEM AND AGGREGATE CAPS SET FORTH THEREIN.

NOTHING IN THESE TERMS LIMITS LIABILITY FOR (a) GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, (b) FRAUD, (c) PERSONAL INJURY OR DEATH CAUSED BY DOHBI’S NEGLIGENCE, OR (d) ANY OTHER LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW. THE LIMITATIONS IN THIS SECTION ARE A FUNDAMENTAL BASIS OF THE BARGAIN BETWEEN YOU AND DOHBI AND WOULD NOT BE OFFERED AT CURRENT PRICES WITHOUT THESE LIMITATIONS. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS IN THIS SECTION; THESE LIMITATIONS APPLY ONLY TO THE EXTENT PERMITTED IN YOUR JURISDICTION.

21. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Dohbi, its affiliates, and their respective officers, directors, employees, contractors, and agents (the “Indemnified Parties”) from and against any third-party claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to (a) your breach of these Terms, (b) your inclusion of Prohibited Items in any Order, (c) your violation of Applicable Law, (d) your infringement of any third-party right, (e) any damage, injury, or loss caused by Customer Items (including biohazards or hazardous materials) you tender to Dohbi, or (f) your willful misconduct or gross negligence. This indemnification does not apply to the extent any claim arises from the gross negligence, willful misconduct, or violation of Applicable Law by Dohbi or any Indemnified Party. Dohbi reserves the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with Dohbi’s defense. You may not settle any indemnified claim without Dohbi’s prior written consent, which will not be unreasonably withheld.

22. TERMINATION BY DOHBI

Dohbi may suspend or terminate your Account or access to the Services at any time, with or without notice, if (a) you breach these Terms, (b) Dohbi is required to do so by Applicable Law, (c) Dohbi reasonably suspects fraud, abuse, or misuse, (d) Dohbi discontinues the Services in the Service Area, or (e) your conduct creates a safety risk to Dohbi personnel or other Customers. If Dohbi terminates your subscription other than for cause (such as discontinuation of Services in your Service Area or business-driven plan retirement), Dohbi will issue a pro-rata refund of prepaid, unused fees attributable to the remainder of the then-current Subscription Term. No refund is owed where termination is for cause attributable to you (including breach, fraud, abuse, or safety risk). Upon termination, your rights to use the Services cease; Sections 1, 6, 7, 8, 11, 14, 16, 19, 20, 21, 24, 25, and 26 through 34 (and any other provisions that by their nature should survive) will survive.

23. ELECTRONIC COMMUNICATIONS; SMS / TEXT MESSAGES

23.1 Service Communications by Default

Dohbi will send all essential service-related communications (including pickup confirmations, delivery notifications, billing receipts, renewal reminders, account alerts, claim updates, and material notices) by email to the address associated with your Account or by in-app notification. You do not need to opt into SMS to receive essential service communications. If you do not opt into SMS, you will continue to receive these notices through email and the Platform without any reduction in Service.

23.2 Dohbi Laundry Updates — Optional SMS Program

Tampa Laundry Company LLC d/b/a Dohbi operates the Dohbi laundry-update SMS program. By affirmatively selecting the separate, unchecked SMS checkbox and providing your mobile number, you consent to automated service-only texts: an enrollment confirmation, scheduled pickup reminders, washer-on-the-way notices, pickup confirmations, delivery updates, and delivery confirmations. SMS consent is optional and is not a condition of purchasing or using the Services. This program does not send marketing, promotional messages, or authentication/one-time passcodes (OTPs). Providing a phone number alone does not grant SMS consent.

23.3 Frequency; Rates; Help; Stop

One enrollment confirmation, then up to 5 messages per laundry order. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help, or contact hello@dohbi.com. You may also use STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT to opt out, and INFO for help. Reply START or UNSTOP to resume where supported by the messaging service. Opting out of SMS does not opt you out of email or in-app service communications. Carriers are not liable for delayed or undelivered messages.

23.4 Recordkeeping; No Third-Party Marketing

Dohbi maintains records of SMS consents, the consent language and method, and opt-outs for not less than five (5) years to demonstrate compliance with TCPA, FTSA, and similar statutes. We do not sell, rent, or share mobile phone numbers or SMS consent information with third parties or affiliates for their marketing or promotional purposes. Contracted messaging providers may process this information solely to deliver and support the messages you requested. SMS consent does not authorize unrelated messages from another business.

Terms: https://dohbi.com/legal/terms. Privacy: https://dohbi.com/legal/privacy.

23.5 Compliance with Law

All SMS communications are sent in accordance with the Telephone Consumer Protection Act (47 U.S.C. § 227), the Florida Telephone Solicitation Act (Fla. Stat. § 501.059), and FCC rules at 47 C.F.R. § 64.1200, including with respect to consent, time-of-day restrictions, content, and identification of the sender. Where Applicable Law imposes higher standards, those standards control.

24. DISPUTE RESOLUTION; BINDING ARBITRATION; CLASS ACTION WAIVER

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO A JURY TRIAL AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION.

24.1 Informal Resolution

Before initiating arbitration or any other proceeding, you and Dohbi agree to attempt in good faith to resolve any dispute informally for at least 60 days. You must send a written notice of dispute to claims@dohbi.com (with a copy by U.S. mail to the address in Section 34) describing the nature and basis of the claim, the relief sought, and your name and Account email address. Dohbi may send a notice of dispute to the email address associated with your Account. The applicable statute of limitations and any filing-fee deadlines will be tolled during the informal resolution period. Compliance with this Section 24.1 is a condition precedent to commencing arbitration, and an arbitrator may dismiss any demand filed without it (subject to refiling after compliance).

24.2 Agreement to Arbitrate

Any dispute, claim, or controversy arising out of or relating to these Terms, the Services, the Platform, your Account, your communications with Dohbi, or your relationship with Dohbi (a “Dispute”) that is not resolved informally will be resolved exclusively by binding individual arbitration administered by JAMS pursuant to the JAMS Streamlined Arbitration Rules and Procedures (or, for claims exceeding $250,000, the JAMS Comprehensive Arbitration Rules and Procedures), as modified by these Terms. This arbitration agreement is governed by the Federal Arbitration Act, 9 U.S.C. §§ 1 et seq.

24.3 Delegation

The arbitrator, and not any federal, state, or local court, has exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement, including any claim that all or any part of it is void or voidable. Notwithstanding the foregoing, a court of competent jurisdiction has exclusive authority to determine the enforceability of the Class Action Waiver in Section 24.5.

24.4 Arbitration Procedure

Arbitration will be conducted by a single neutral arbitrator. The arbitration will be conducted in Hillsborough County, Florida, or, at your election, in the county in which you reside; in either case, the arbitration may be conducted by telephone or videoconference, or, for claims of $25,000 or less, on the basis of documents submitted to the arbitrator unless the arbitrator orders otherwise. The arbitrator may award any relief that a court of competent jurisdiction could award, except that the arbitrator may not award relief inconsistent with the Class Action Waiver. The arbitrator’s award is final and binding and may be entered as a judgment in any court of competent jurisdiction.

24.5 Class Action Waiver

YOU AND DOHBI AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, MASS, OR REPRESENTATIVE PROCEEDING (INCLUDING ANY PRIVATE-ATTORNEY-GENERAL ACTION WHERE PERMITTED BY APPLICABLE LAW). The arbitrator may not consolidate more than one person’s claims or otherwise preside over any form of representative, class, or mass proceeding. If this Class Action Waiver is found unenforceable as to any claim, that claim alone will be severed and heard in court; all other claims remain subject to arbitration.

24.6 Mass Arbitration Procedures

If 25 or more similar demands for arbitration are filed against Dohbi by or with the assistance of the same law firm or coordinated group within a 90-day period, the parties agree that the demands will be administered as a “Mass Filing” under any then-current JAMS mass arbitration procedures. Pending the establishment or selection of such procedures, the parties agree to bellwether procedures: (a) the parties will select 10 representative cases (5 each) to proceed first; (b) the remaining cases will be stayed; and (c) the parties will engage in good-faith mediation following completion of the bellwether cases before any other cases proceed. The applicable statute of limitations and all filing deadlines will be tolled for stayed cases.

24.7 Arbitration Costs

Dohbi will pay all JAMS filing, administrative, and arbitrator fees that exceed the cost of filing a comparable claim in a state court of general jurisdiction in your county of residence, to the extent such fees would render arbitration prohibitively expensive. Each party otherwise bears its own attorneys’ fees and costs, except that the arbitrator may award attorneys’ fees and costs to you (but not to Dohbi) to the extent provided by Applicable Law (such as the Florida Deceptive and Unfair Trade Practices Act or other fee-shifting consumer-protection statutes). This Section is not intended to alter the substantive remedies available to you under Applicable Law.

24.8 Small Claims Exception

Notwithstanding the foregoing, either party may bring an individual action in small claims court for a Dispute within the scope of that court’s jurisdiction, in lieu of arbitration, provided the action remains in small claims court and is not removed or transferred.

24.9 Injunctive Relief Exception

Either party may seek emergency or preliminary injunctive relief in a court of competent jurisdiction to protect intellectual property rights (Section 14), confidential information, or to enforce Sections 6 (Customer Responsibilities), 7 (Prohibited Items), or 13 (User Conduct), pending arbitration. Seeking such relief is not a waiver of either party’s right to arbitration.

24.10 30-Day Right to Opt Out

You may opt out of this Section 24 by sending written notice within 30 days of first accepting these Terms, by either: (a) email to legal@dohbi.com with subject line “Arbitration Opt-Out,” or (b) U.S. mail to Tampa Laundry Company LLC d/b/a Dohbi, 4520 West Gandy Boulevard, Tampa, Florida 33611, Attn: General Counsel — Arbitration Opt-Out. The notice must include your name, the email address associated with your Account, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other provision of these Terms, including the jury trial waiver in Section 24.11.

24.11 Jury Trial Waiver (For Non-Arbitrable Claims)

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND DOHBI EACH WAIVE THE RIGHT TO A TRIAL BY JURY IN ANY ACTION, PROCEEDING, OR COUNTERCLAIM ARISING OUT OF OR RELATING TO THESE TERMS THAT IS NOT SUBJECT TO ARBITRATION.

24.12 Survival; Severability

This Section 24 will survive termination of these Terms. If any provision of this Section 24 (other than the Class Action Waiver) is held unenforceable, the remainder will remain in effect; if the Class Action Waiver is held unenforceable as to a claim, that claim is severed under Section 24.5.

25. GOVERNING LAW; VENUE; LIMITATION OF ACTIONS

25.1 Governing Law

These Terms, and any dispute arising under or relating to them, are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles, except that the Federal Arbitration Act governs Section 24. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

25.2 Venue for Non-Arbitrable Claims

For any claim or action not subject to arbitration under Section 24, you and Dohbi each consent to the exclusive personal jurisdiction and venue of the state courts of the Thirteenth Judicial Circuit in and for Hillsborough County, Florida, and the United States District Court for the Middle District of Florida, Tampa Division, and waive any objection based on inconvenient forum. Nothing in this Section limits the right of a Florida resident to bring a claim under the Florida Deceptive and Unfair Trade Practices Act in any forum permitted by that Act.

25.3 One-Year Contractual Limitation Period

To the fullest extent permitted by Applicable Law, any claim or cause of action arising out of or relating to these Terms or the Services must be commenced (whether in arbitration, small claims court, or court) within one (1) year after the cause of action accrued, or it is permanently barred. This Section does not apply to (a) claims under the Florida Deceptive and Unfair Trade Practices Act (Fla. Stat. § 501.201 et seq.), the Florida Telephone Solicitation Act (Fla. Stat. § 501.059), or other Florida or federal consumer-protection statutes that prescribe a non-waivable limitations period, or (b) any other claim that, under Applicable Law, cannot be subject to a shortened limitations period.

26. NOTICES

Dohbi may give notice to you by email to the address associated with your Account, by in-app notification, or by posting on the Platform; notice is effective on transmission. You must give notice to Dohbi as follows:

  • Customer Support: hello@dohbi.com
  • Claims: claims@dohbi.com
  • Cancellations: cancel@dohbi.com
  • Legal Notices: legal@dohbi.com, with a copy by certified U.S. mail to Tampa Laundry Company LLC d/b/a Dohbi, 4520 West Gandy Boulevard, Tampa, Florida 33611, Attn: General Counsel.

27. MODIFICATIONS TO THESE TERMS

Dohbi may modify these Terms from time to time. For non-material changes, Dohbi will post the updated Terms on the Platform with a revised “Last Updated” date. For material changes that adversely affect your rights, Dohbi will provide at least 30 days’ advance notice by email or in-app notification (or such longer period as required by Applicable Law), and the material change will take effect only after that notice period. Continued use of the Services after the effective date of the changes constitutes your acceptance of the modified Terms. If you do not agree to the changes, you may cancel your Subscription Plan under Section 10 before the changes take effect, and the Cancellation Fee will not apply to a cancellation made specifically and within 30 days in response to a material adverse change. Where Applicable Law in your state requires affirmative re-consent to material changes, Dohbi will solicit such consent through the Platform.

28. ASSIGNMENT

You may not assign or transfer these Terms or any rights hereunder without Dohbi’s prior written consent. Any attempted assignment in violation of this Section is void. Dohbi may assign these Terms, in whole or in part, without notice or consent, including in connection with a merger, acquisition, reorganization, financing, or sale of assets.

29. SEVERABILITY; WAIVER

If any provision of these Terms is held invalid or unenforceable by an arbitrator or court of competent jurisdiction, the remaining provisions will continue in full force, and the invalid provision will be modified to the minimum extent necessary to render it enforceable while preserving the parties’ original intent. The failure of either party to enforce any right or provision of these Terms is not a waiver of that right or provision.

30. SURVIVAL

The following provisions, and any other provisions that by their nature should survive, will survive any termination or expiration of these Terms: Sections 1 (Definitions), 5.4 (Failed Payments), 5.5 (Refunds), 5.7 (Anti-Abuse), 6 (Customer Responsibilities), 7 (Prohibited Items), 8 (Loss, Damage, and Claims), 11 (Chargebacks), 12 (Abandoned Items), 14 (Intellectual Property; User Content; Feedback), 15 (Privacy), 16 (Disclaimers), 19 (Independent Contractors), 20 (Limitation of Liability), 21 (Indemnification), 24 (Arbitration), 25 (Governing Law; Limitation of Actions), and Sections 26 through 34.

31. ENTIRE AGREEMENT

These Terms, together with your Order(s), Subscription Plan, the Privacy Policy, and any supplemental terms expressly referenced, constitute the entire agreement between you and Dohbi regarding the Services and supersede all prior or contemporaneous communications, whether electronic, oral, or written. No oral or written representation by any Dohbi representative or contractor that is inconsistent with these Terms is binding.

32. STATE-SPECIFIC DISCLOSURES

The following state-specific provisions apply to Customers residing in the identified states. Where these provisions conflict with other provisions of these Terms, the state-specific provisions control for the identified Customers.

32.1 Florida

Florida residents: Auto-renewal disclosures comply with the Florida Automatic Renewal Act (Fla. Stat. § 501.165). Because Dohbi’s Subscription Plans are semester-length and the Fall-to-Spring auto-renewal under Section 10.2 carries the customer for less than 12 months, the long-term renewal notice provisions of Fla. Stat. § 501.165(3) do not apply to Dohbi’s current Subscription Plan structure. If Dohbi offers Subscription Plans of 12 months or longer in the future, Dohbi will provide the renewal notice required by that statute. Nothing in these Terms is intended to waive, and Dohbi does not assert, any limitation of any non-waivable right under the Florida Deceptive and Unfair Trade Practices Act (Fla. Stat. § 501.201 et seq.) or any other Florida statute.

32.2 California

California residents: Pursuant to California Civil Code § 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N-112, Sacramento, CA 95834, or by telephone at (800) 952-5210. Auto-renewal disclosures and online cancellation methods comply with California Business & Professions Code §§ 17600 et seq. (Automatic Renewal Law). California residents may cancel a Subscription Plan online through the Platform’s cancellation feature without contacting Dohbi by other means.

32.3 New York

New York residents: Auto-renewal disclosures are provided in accordance with New York General Business Law § 527-a. Renewal notices will be sent between 15 and 45 days before any automatic renewal of a Subscription Term of one year or longer.

32.4 Other States

Customers in other states may have additional rights under their state’s consumer protection laws, including the right to cancel within a statutory cooling-off period and the right to notice of auto-renewal terms. Nothing in these Terms is intended to waive or limit any such non-waivable rights.

33. MOBILE APPLICATION TERMS

If you access the Services through a Dohbi mobile application obtained from the Apple App Store or Google Play (each, an “App Store”), you acknowledge: (a) these Terms are between you and Dohbi only, and not with the App Store; (b) Dohbi (and not the App Store) is solely responsible for the application and Services; (c) the App Store has no obligation to provide maintenance or support for the application; (d) the App Store is a third-party beneficiary of these Terms with the right to enforce them against you; and (e) you will comply with all applicable App Store usage rules.

34. MISCELLANEOUS; CONTACT INFORMATION

34.1 Construction

Headings are for convenience only and do not affect interpretation. The words “including” and “include” mean “including, without limitation.” References to dollar amounts are to U.S. dollars. No third party is intended to be a beneficiary of these Terms except as expressly stated. These Terms may be executed and accepted electronically and in counterparts, each of which is deemed an original. Ambiguities will not be construed against the drafter. Dohbi’s rights and remedies under these Terms are cumulative and not exclusive of any rights or remedies available at law or in equity.

34.2 Relationship

These Terms do not create any agency, partnership, joint venture, employment, or franchise relationship between you and Dohbi.
